Terms of Service

1 Purpose

SmartCouture is an online service (SaaS) for managing a tailoring business: orders, clients, measurement sheets, finances, SMS and WhatsApp notifications, online catalogue and shop. These terms apply to the smartcouture.app website, the iOS and Android mobile apps and the portail.smartcouture.app web portal.

2 Publisher

3 Account and access

• Your account is created from the mobile app or the web portal, in seconds.
• Your credentials are personal: you are responsible for keeping them confidential and for actions taken from your account.
• The service is intended for professional use by adults.
• On the Business plan, you can create accounts for your team and define their roles and permissions.

4 Plans and pricing

Three plans are available, priced in CFA francs (XOF):

• Essential — 4,900 FCFA/month (or 44,100 FCFA/year)
• Mobile — 14,000 FCFA/month (or 126,000 FCFA/year)
• Business — 35,000 FCFA/month (or 315,000 FCFA/year)

Annual billing carries a 25% discount. Orders are unlimited on every plan. The features of each plan are detailed on the Pricing page, which forms part of these terms.

If prices change, you are notified at least 30 days in advance (by email or in-app notification). The new price only applies from the next period — never to a period already paid.

5 Free trial

The Essential plan includes a 14-day free trial, with no commitment and no payment at sign-up. When the trial ends, you can subscribe or stop at no cost. The Mobile and Business plans start straight away, without a trial period. The trial is limited to one per workshop.

6 Payment and renewal

• Accepted methods: Orange Money, Wave, M-Pesa, MTN MoMo, Airtel Money, Moov Money, Free Money, PayPal and bank card (Visa, Mastercard).
• Your subscription is activated on receipt of payment, for the chosen duration (monthly or annual).
• If it is not renewed at the end of the period, access becomes restricted — your data is not deleted (see section 8).
• A receipt is available for every payment.

7 Cancellation

You can cancel at any time, without reason or notice. Cancellation takes effect at the end of the period already paid: you keep full access until that date. Started periods are not refunded, unless the law requires otherwise.

8 Your data

• The data you enter in SmartCouture (clients, orders, measurements, finances, photos) remains your workshop's property.
• After your subscription ends, it is kept for 90 days — time to come back or request an export — then deleted.
• You can request an export of your data at any time at contact@smartcouture.app.
• Towards your own clients, you remain responsible for the data you enter: make sure they are informed of how their contact details are used.

9 SMS and WhatsApp notifications

• Notifications (order received, in progress, ready…) are sent to your clients in your workshop's name, depending on your plan.
• WhatsApp uses official templates approved by WhatsApp Business, which cannot be modified.
• You agree to use these messages only to keep your clients informed about their orders — never for unsolicited marketing.
• Final delivery depends on telecom operators and WhatsApp, which we do not control.

10 Availability and support

• We aim for maximum service availability; occasional maintenance may occur.
• The mobile app works offline: you keep working without a connection, and everything syncs afterwards.
• Support in French by phone, WhatsApp (+221 78 687 55 37) and email, Monday to Saturday.

11 Liability

DefarSoft does its utmost to provide a reliable service, but cannot be held liable for indirect damages (loss of business, loss of clientele), interruptions caused by third parties (telecom operators, hosting provider, payment services) or force majeure. In any event, DefarSoft's liability is limited to the total amounts you have paid over the last 12 months.

12 Governing law

These terms are governed by Senegalese law. In the event of a dispute, we will first seek an amicable solution; failing that, the courts of Dakar will have jurisdiction.

13 Changes

These terms may evolve with the service. The date of the last update appears at the top of this page; in the event of a significant change, you will be notified via the app or by email. Continuing to use SmartCouture after notification constitutes acceptance.
